Who Is a Plaintiff in a Personal Injury Case?
If you have been harmed by another party, you may be able to file a civil lawsuit in a Louisiana court to seek compensation for your damages. As soon as you file, you become the plaintiff. And typically, you will be the only plaintiff.
There are exceptions, though. When a party is alleged to have done something that caused harm to multiple parties, all injured parties might file a claim jointly. In that scenario, all claimants are plaintiffs.
Who Is a Defendant in a Personal Injury Case?
The term “defendant” is a little more confusing, as it means different things in criminal and civil courtrooms. In a criminal courtroom, a defendant is an individual who has been charged with a crime. However, in a civil courtroom, a defendant is someone who is alleged to have injured the plaintiff.
Just as there is usually only one plaintiff, there is also usually only one defendant. However, in the same vein, there can be exceptions. As long as all parties in a lawsuit were at least partially responsible for the harm you suffered, you could file a lawsuit against multiple parties, thus forming a case with several defendants.

There are a number of types of civil lawsuits. For example, if someone were to break a contract with you, you could file a lawsuit against them. But that would not be a personal injury claim.
The latter occurs when one person alleges that another party’s negligent or intentional actions caused bodily, emotional, and/or psychological harm. Thus, if you were involved in a car accident, the resulting lawsuit would typically be a personal injury case, as most collisions occur when one driver is negligent.
If, for example, the other driver was looking at their phone instead of paying attention to the road, they would be negligent. You could then file a lawsuit against them, making you the plaintiff and the other driver the defendant.
Similarly, if you were a victim of clergy sexual abuse as a child, you could file a lawsuit later in life. As the victim of an intentional action, you would be the plaintiff, and the individual who assaulted you would be the defendant.
You might also name the church or administrators thereof as defendants if their actions made it easier for you to be abused or if they protected the abuser.
